It's a classic example of an Argument by Artifice - a "legal chill". Usual superficial legal bullying to bury someone's idiocy as exposed by, in this case, Ben Goldacre. I'm no lawyer, but using a small clip of audio or video for educational or journalistic purposes should be A Okay under "fair use". That's exactly what the news does everyday.
